Last month, the U.S. Environmental Protection Agency (EPA) announced it had reached a settlement with a Connecticut-based residential property management company for allegedly failing to follow certain provisions of the federal Toxic Substances Control Act (TSCA) and the Renovation, Repair and Painting (RRP) Rule. This purportedly occurred while renovating five properties in Connecticut that contained lead paint, including one property in Hartford where two children lived. The settlement includes a civil penalty of over $40k and an agreement by the company to maintain compliance with federal laws that help protect residents from the risks of lead paint exposure.
According to the EPA:
The single largest cause of childhood lead poisoning is from exposure to lead from deteriorated or disturbed lead paint. Nearly 30% of homes in the United States, mostly those built before 1978, have lead-based paint. Under the federal Residential Lead-Based Paint Hazard Reduction Act and TSCA, EPA inspects worksites and records of renovation firms, abatement firms, property managers, landlords, and real estate agents for compliance with lead-related environmental laws and regulations.
“Companies need to be aware of regulations concerning lead in older homes and buildings,” said Joe Frasca, Senior Vice President, Marketing at EMSL Analytical, Inc. “Some of these same properties also have asbestos-containing materials that are subject to health and safety regulations if these materials are disturbed. To help business owners and managers, EMSL Analytical has laboratories across North America that provide environmental, material, and industrial hygiene testing services for lead, asbestos, and other regulated substances. We also offer sampling supplies, easy-to-use test kits, air monitoring instruments, and personal protective equipment. These resources can be essential for protecting workers and the public from needless exposure risks. They are also key components of effective health and safety programs to keep companies in regulatory compliance.”
